1. Introduction and Agreement
Welcome to BlueCommands. These Partnership Terms of Service ("Terms") govern your partnership with BlueCommands ("we," "us," "our," or "Commands"). By accepting and activating a partnership with us, you ("you," "the Partner") agree to be bound by these Terms in their entirety.
This document constitutes a legally binding agreement. If you do not agree with any part of these Terms, you must not participate in our partnership programs.
2. Definitions
- "BlueCommands" refers to our company and its services. The names "Commands," "Command Hosting," "Command Servers," "Command Server Hosting," and "Command Gaming" are brand and service names used by BlueCommands and may be used interchangeably within this document. These names are protected under Common Law Trademark.
- "Partner" refers to the community, individual, or entity entering into a partnership with BlueCommands.
- "Partnership" refers to the specific arrangement agreed upon, either a Partial Partnership or a Full Partnership.
- "Services" include but are not limited to game server hosting, custom development, community moderation, and web/tool creation provided by BlueCommands.
- "Community" refers to the Partner's group of members, players, or users on platforms like Discord, game servers, and social media.
3. Partnership Programs
We offer two distinct partnership programs. The specific obligations and services provided depend on the program you are enrolled in.
Partial Partnership
"The Standard Package"
Our Obligation
BlueCommands will provide the Partner with high-quality, free game server hosting as agreed upon during the application process.
Partner's Obligation
- Place our name, logo, or link in designated promotional areas.
- Make periodic announcements acknowledging the partnership.
- Direct community members to BlueCommands for hosting inquiries.
Full Partnership
"The All-In-One Solution"
Our Obligation
BlueCommands will act as the Partner's technical backbone, providing management, development, and moderation as agreed.
Partner's Obligation
- Fulfill promotional duties from the Partial Partnership.
- Provide access, permissions, and credentials required for management.
- Collaborate in good faith with our teams.
4. General Terms and Conditions
4.1 Partner Conduct and Responsibilities
- Promotion: Partners must not remove agreed promotional materials for BlueCommands.
- Professional Conduct: No harassment, abuse, or threats toward BlueCommands staff or partners.
- Compliance with Laws: Services must not be used for illegal or unauthorized activities.
- Content Responsibility: Partners are responsible for content and user activity within their Community.
4.2 Intellectual Property
- BlueCommands IP: We retain rights to our brand, logos, sites, software, and tools. Partners are granted a limited license to use promotional materials.
- Partner IP: Partners retain rights to their community branding and user content.
5. Term and Termination
This agreement is effective upon activation and remains in effect until terminated by either party.
5.1 Termination by BlueCommands
We may immediately terminate your partnership for breach of these Terms, harassment, illegal activities, or significant misrepresentation. We may also terminate with seven (7) days' written notice for other reasons.
5.2 Termination by the Partner
Partners may terminate at any time by providing thirty (30) days' written notice.
5.3 Effect of Termination
- Access to BlueCommands Services will be revoked.
- Hosted server data may be permanently deleted.
- Partners must remove BlueCommands promotional materials immediately.
6. Disclaimer
Services are provided "as is" and "as available" without warranties. We do not guarantee uninterrupted or error-free service.
To the fullest extent permitted by law, BlueCommands is not liable for indirect, incidental, special, or consequential damages, including loss of data or profits.
7. Modification of Terms
We may update these Terms at any time and will provide notice for material changes. Continued use implies acceptance.
